READ THE FOLLOWING SECTIONS FULLY AND CAREFULLY PRIOR TO SIGNING. THIS IS A LEGALLY VALID AND BINDING OBLIGATION TO RELEASE COMPANY FROM ALL KNOW AND UNKNOWN OBLIGATIONS, AND TO IDEMNIFY COMPANY AGAINST CLAIMS BROUGHT AGAINST IT BASED UPON YOUR USE OF THE GOLF CART. THIS INSTRUMENT AFFECTS IMPORTANT LEGAL RIGHTS.

Release and Waiver of Claims

For valuable consideration, the receipt and sufficiency of which are hereby acknowledged Renter does hereby remise, release, and forever discharge Company. Company's agents, servants, successors, heirs, executors, administrators and personal representatives. of and from all, and all manner of, actions, causes of action suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity which Renter ever had, now has, or which Renter's heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of the Agreement, out of the use (misuse, or abuse) of the Golf Cart: or in any way arising out of the rental relationship between Renter and Company.

Indemnification

For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged. Renter hereby expressly agrees to indemnify and hold harmless Company, Company's agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter's use, misuse, or abuse of the Golf Cart.

Terms and Conditions

1) Assumptions of Risk: Renter acknowledges that the activities for which the Golf Cart is designed include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the Golf Cart.

2) Acceptable Use: Renter agrees and acknowledges that he/she will be the sole operator of the Gold Cart and will use the Golf Cart in a careful, safe, and conscientious manner. The Renter shall always observe and adhere to any rules and guidelines posted by the Company, and any applicable laws or regulations. Renter shall always be responsible for the safety of all passengers on the Golf Cart.

3) Prohibited Activities: Renter shall not violate any of the following rules and regulations during his/her operation of the Golf Cart.

• There is no smoking while in Golf Cart.

• The Operator is not allowed to consume alcoholic beverages while operating Golf Cart. The company reserves the right to inspect any coolers, bags or other containers belonging to Renter or any of Renter's passengers.

• Pets are NOT permitted on a Golf Cart

• Maximum four adults per Golf Cart.

• Do not drive on the beach (you'll get stuck!)

4) Age: The Renter is at least 18 years of age. NO one under the age of 16 is permitted to operate a Golf Cart. Any renter allowing a person under 16 to operate will be fined $100.

5) Unsafe Use: If at any time the Company determines that Renter has engaged in an unsafe or hazardous use of Golf Cart, Company may notify the Renter that their rental agreement is immediately terminated. Upon termination, Renter must return Golf Cart to the designated area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit. Company shall determine, in its sole discretion, whether any behavior or activity is "unsafe" or "hazardous."

6) Condition of Golf Cart Upon Return: The Renter shall return the Gold Cart to the designated area clean, free of garbage and debris, and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the Golf Cart during the rental period. The company shall retain any portion (or all) of Renter's security deposit as necessary to cover repairs for such damage. To the extent that damages to the Golf Cart exceed the amount of the security deposit. Renter shall be billed by Company for the full amount of damages caused by Renter during the rental period, including reasonable attorney's fees.

7) Late Return: If Renter returns the Golf Cart to the designated area more than 20 minutes after the predetermined "Time In", Renter shall forfeit his/her security deposit.

Assumption of Risk: By renting this golf cart, you acknowledge and accept all risks involved, including injury or death.

Use of Golf Cart: You agree to operate the golf cart yourself and responsibly, following all posted rules, laws and regulations. You are responsible for the safety of all passengers.

Prohibited Activities: No smoking or alcohol consumption while operating the golf cart. Pets are not allowed. Maximum occupancy is four adults. Do not drive on the beach.

Unsafe Use: If the company determines you are using the golf cart unsafely or hazardously, they may immediately terminate the rental. You will forfeit your security deposit if rental is terminated for this reason.

Return Conditions: Return the golf cart clean and in the same condition as received, except for normal wear and tear. You are liable for any damages during the rental period, and repairs may be deducted from your security deposit. You may be billed for damages exceeding the deposit.

Late Return: Return the golf cart on time to avoid forfeiting your security deposit. Late returns beyond 20 minutes may result in deposit forfeiture.

Age Requirement: You must be at least 18 years old to rent and operate the golf cart. No one under 16 may operate it, and allowing this will result in a $100 fine.

Renter has read and understands all the terms, conditions and rules set forth above, and agrees to all terms without reservation.

The company agrees to rent the following golf cart to Renter, upon the condition that Renter agrees to all terms and conditions set forth above, including the release of claims, and evidence that agreement with his/her signature in space provided.

** This does not guarantee your rental. This form will need to be confirmed with your event specialist from the Lodge. Based on availability.
