Acknowledgment of Risks: The Renter acknowledges and understands that operating and renting a watercraft involves inherent risks including but not limited to risks of injury, death, and property damage. The Renter voluntarily assumes all risks associated with the operation and use of the watercraft.
Waiver and Release: In consideration of being allowed to rent and operate a watercraft from the Resort, the Renter, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby waives, releases, and discharges the Resort, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to the Renters use of the watercraft, including but not limited to any injury, death, or property damage.
Responsibility for Damages: The Renter agrees to be financially responsible for any and all damages to the watercraft and any associated equipment that occur during the rental period. The Renter authorizes the Resort to charge the credit card on file for any repair or replacements necessary, due to such damages.
Compliance with Laws and Regulations: The Renter agrees to comply with all local, state, and federal laws and regulations while operating the watercraft. The Renter acknowledges that failure to comply with these laws and regulations may result in fines and penalties or other legal consequences for which the Renter will be solely responsible.
Indemnification: The Renter agrees to indemnify, defend, and hold harmless the Resort, its owners, employees, agents and affiliates from and against any and all claims, liabilities, damages, or causes of action brought by third parties arising out of or related to the Renters use of the watercraft.
Condition of Watercraft: The Renter will be instructed by Appeldoorn's Staff on the use of the watercraft and conduct a joint inspection of the watercraft prior to the guest's use. The Renter agrees to return the watercraft in the same condition in which it was received. Pictures will be taken prior to and after the rental of the watercraft to document any changes in the condition of the watercraft. Renter understands and agrees they are responsible for any damage that may occur during their use of the watercraft.
Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of Minnesota. Any legal action or proceeding arising out of or related to this Waiver shall be brought exclusively in the courts of the State of Minnesota.
Entire Agreement: This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements or understandings, whether written or oral.
Severability: If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment of Understanding: The Renter acknowledges that they have read this Waiver, understand its terms and agree to be bound by them. The Renter further acknowledges that they are signing this Waiver freely and voluntarily with full knowledge of its legal significance.
Minimum Age and Operational Restrictions: The Renter acknowledges that the minimum age to rent and operate the watercraft is 21 years old. Additionally the watercraft must be returned to the Resort by 6:45pm local time. Failure to comply will result in a fine of $200.00
Prohibited Activities: The Renter agrees that activities such as tubing, water skiing, or any similar activities are strictly prohibited while using the watercraft rented from the Resort.
